CAROLINA BALLET/NUTCRACKER SWEEPSTAKES Official Rules NO PURCHASE NECESSARY TO ENTER OR WIN Sponsor: The Carolina Ballet/Nutcracker Sweepstakes (“Promotion”) is sponsored by Carolina Ballet, Inc., 3401-131 Atlantic Avenue, Raleigh, NC 27604 (“Sponsor”) Eligibility: Promotion is open to legal residents of the United States (excluding FL), who are eighteen (18) years of age or older and have a valid driver’s license in their state of residence at the time of entry. Employees of Sponsor and family members living in the same household of such employees are not eligible to participate or win. By entering the Promotion, participants are bound by and agree to these official rules. All federal, state and local laws and regulations apply. Void in Florida and where prohibited by law. Promotion Period: The Promotion begins at 12:01 A.M. ET on 2/14/2008 and ends at 11:59 P.M. ET on 12/9/2008 (the “Promotion Period”). How to Enter During the Promotion Period: How to Register and Enter by Purchasing Nutcracker Tickets: If you purchase any number of Sponsor’s Nutcracker tickets during the promotional period, you will automatically be entered to win. Limit one entry per household. Free method of entry by Mail: To enter the Promotion by mail, hand print your name, complete address, zip code, date of birth, home phone number and email address on a plain 3”X 5” piece of paper marked "Nutcracker Sweepstakes" and mail it in a hand-addressed, stamped envelope, to: Carolina Ballet, Inc., 3401-131 Atlantic Avenue, Raleigh, NC 27604. To be a valid, entry must contain at least one valid phone number and one valid email. All mail-in entries must be mailed separately, must be postmarked by December 9, 2008, and received by December 17, 2008, to be included in the random drawing. Limit one entry per household. Random Drawing: The Grand Prize winner will be randomly selected on or about December 19, 2008, from among all eligible entries received. Odds of winning will be dependent upon the number of eligible entries received. Grand Prize will be awarded and winner will be notified within 48 hours by telephone/mail. Prize is nontransferable and no substitution is allowed. The Sponsor assumes no responsibility or liability for damages, losses or injury resulting from acceptance or use of prize. Prize: One (1) Grand Prize: 4-day/3-night vacation for up to four (4) people (winner and up to three (3) guests) to Orlando, FL. Prize includes the following: Round-trip coach air transportation for up to four (4) between Raleigh-Durham Airport to Orlando International Airport; round-trip ground transfers for up to four (4) between airport and hotel; three (3) nights accommodations for four (4); and eight (8) park passes for Walt Disney World®. Approximate retail value (“ARV”) of Grand Prize: up to $3,000.00. All other costs and expenses on the receipt and use of the prize not specifically mentioned herein, including but not limited to meals not specifically listed as included, travel insurance, room service, laundry service, local and long distance telephone calls, merchandise and souvenirs, incidental expenses, additional tips and gratuities, income taxes, and sales tax are solely the responsibility of winner and guests. All travel must be completed by December 19, 2009 or prize is forfeited. All travel subject to availability, blackout periods, government restrictions and regulations, hotel, airline, airport or other transportation terminal (or other types of transportation) restrictions and regulations. Other restrictions may apply. Sponsor is not responsible for cancelled, delayed, suspended or rescheduled events (including airline flights beyond its control). Winner and guests must each have all necessary identification and/or travel documents (e.g., a valid U.S. driver's license) required for travel within the United States. Winner and travel guests must travel together on the same itinerary. All guests who are minors in their state of residence must be accompanied by their parent or legal guardian who must be either the winner or a guest of the winner. Guests have no independent right or claim to any prize. Any portion of a prize not accepted by winner or winner's guest will be forfeited. Prize must be accepted as awarded. Prize is non-transferable and no substitutions or cash redemptions will be made except as provided herein or at Sponsor's sole discretion Winner Notification: The potential Grand Prize winner will be required to execute and return an affidavit of eligibility/release of liability within ten (10) days of attempted notification. If affidavit is not received by Sponsor within ten (10) days, or the prize notification letter is returned undeliverable, the potential winner will be disqualified and an alternate winner will be selected. General Conditions: By entering, entrants fully and unconditionally agree and accept to be bound by these complete Official Rules and the decisions of the Sponsor, which shall be final. Except where prohibited, the Grand Prize winner grants to the Sponsor the right to use, and publish his or her proper name without additional compensation. By participating, entrants agree to release and hold harmless Sponsor, its officers, directors, agents and employees from any and all liability related to or arising out of: (i) late, lost, delayed, damaged, illegible, mutilated, mistranscribed, misdirected, incorrect, incomplete, ineligible, unintelligible entries or postage-due mail; (ii) any condition caused by events beyond their control that may cause the Promotion to be disrupted or corrupted; (iii) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, use or misuse of prize, or from participation in the Promotion; or (iv) any printing or typographical error in any materials associated with these Official Rules or the Promotion generally. Entrants assume all liability for any injury or damages caused or claimed to be caused by their participation in the Promotion and/or the acceptance and/or use of any prize, and release the Promotion Entities and their respective officers, directors, employees, parents, subsidiaries and affiliates from any and all such liability. Disputes: Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prize awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in North Carolina; entrant submits to sole and exclusive personal jurisdiction to said courts in the state of North Carolina for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMIATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant or Sponsor in connection with this Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of North Carolina, the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of North Carolina.
